The indictment alleges that between September 2005 and July 2006 Malloy enticed a female minor to engage in graphic sexual intercourse in order to produce a picture of that conduct. The indictment further alleges that on August 2, 2006 Malloy possessed a videotape containing images of child pornography. According to court documents filed in a related case in the District of Columbia, Malloy was a sergeant with the U.S. Capitol Police during this time. Malloy faces a maximum penalty of 30 years in prison followed by 5 years of supervised release for production of child pornography; and 10 years in prison followed by 3 years of supervised release for possession of child pornography. No court date has been scheduled. An indictment is not a finding of guilt. An individual charged by indictment is presumed innocent unless and until proven guilty at some later criminal proceedings. United States Attorney Rod J. Rosenstein commended the investigative work performed by the Federal Bureau of Investigation and the Washington D.C. Metropolitan Police Department. Mr. Rosenstein thanked Assistant U.S. Attorney Michele Sartori, who is prosecuting the case. |
